Terms of Service

Who we are: MonkeyServers is run by Daniel Milanesi, trading as MonkeyServers, a sole trader in the United Kingdom. Postal address: 53 Wickham Rd, Beckenham BR3 6QJ, UK. Email: [email protected].

In these terms, "we" and "us" means MonkeyServers, and "you" means the player or customer.

1. These terms

These terms cover our Rust game servers, this website and store, and our Discord (together, the "Service"). By using the Service or buying from the store, you agree to them. Please also read our refund policy, our privacy policy and the rules of the server you play on, shown on each server's page.

2. Who can play and who can buy

To play or sign in, you need a Steam account. Steam accounts are for people aged 13 and over.
To buy from the store, you must be 18 or over, or have permission from a parent or guardian who owns the payment method or the items you trade.

3. Your account

You sign in with Steam. Keep your Steam account secure. We never see your Steam password.
Everything you buy is linked to the Steam account you signed in with. It is for your own use and cannot be sold or passed to someone else. We cannot normally move it to another Steam account.

4. Acceptable use

You agree not to:

use cheats, hacks, exploits or third-party software that gives an unfair advantage on any MonkeyServers server;
harass, threaten, bully or discriminate against other players;
sell or trade access to DLC skins or building skins on our servers;
try to get into our servers, website or other players' data without permission;
break the server rules or the law.

5. What we sell

VIP and VIP+ are ranks on every MonkeyServers server. The perks for each rank are listed in the store. VIP never gives an advantage in a fight.

VIP Wipe Pass: one payment for 7 days of VIP, starting when it is delivered. Nothing renews.
VIP Monthly, VIP 3 Months, VIP+ Monthly and VIP+ 3 Months: subscriptions paid by card that renew automatically at the end of each period until you cancel (section 7).
VIP Lifetime and VIP+ Lifetime: one payment. They last for as long as MonkeyServers runs Rust servers (section 8).

A few rules apply:

The VIP Wipe Pass is one per Steam account, ever. Refunds and chargebacks do not reset it, so a refunded Wipe Pass cannot be bought again.
Upgrades. If you own VIP Lifetime, you can upgrade to VIP+ Lifetime and pay only the difference. The upgrade is its own payment: if it is refunded, only VIP+ is removed and your VIP Lifetime stays. If your VIP Lifetime is refunded or charged back, we may also remove the upgrade, because its price assumed you had paid for VIP Lifetime. Where your account page offers it, a VIP Monthly or VIP 3 Months plan paid by card can move up to the VIP+ plan of the same length: you pay the difference for the rest of the current period straight away, then it renews at the VIP+ price.
All prices are in pounds sterling (GBP) and include VAT. The total shown before you pay is the total you pay.
We may change prices for new purchases. A price change never applies to a subscription you already have unless we tell you at least 30 days before your next renewal, so you can cancel first.

6. Paying and delivery

By card. PayNow Services, Inc. ("PayNow") is the authorised seller and Merchant of Record for every purchase paid through PayNow checkout. PayNow takes the payment and collects it on our behalf. PayNow's own buyer agreement also applies to the payment. We supply the VIP, and we are responsible to you for it.

By skin trade. You can also pay by trading Steam skins. Skin trades are handled by hand:

You create an order in the store, then open a ticket in our Discord with your order reference and send the trade.
Our staff check the trade and confirm it, with the estimated value of the items. Your VIP starts when staff confirm the trade, not before.
For skin trade orders we are the seller. PayNow is not involved.
A plan that renews by card does not renew when paid by skin trade. You get one fixed period: 30 days for a Monthly plan, 90 days for a 3 Months plan. If you buy more than one of the same plan, the periods add up. When it ends, VIP ends, unless you buy again.
If a trade is reversed or the items are taken back after we confirm it, we treat it like a chargeback (section 10).

Delivery. Perks are delivered automatically to your Steam account on every MonkeyServers server, usually within a minute or two of your payment being confirmed. Perks that need you in the game are applied the next time you join the server.

Your right to cancel. Before you pay, you ask us to start delivery straight away and confirm that you lose your 14 day right to cancel once delivery starts. We record when you did this, and you can see it on your order in your account. The refund policy explains the details.

7. Subscriptions and cancelling

Monthly and 3 Months plans paid by card renew automatically at the end of each period until you cancel.
You can cancel at any time. Sign in, open your account page and choose Cancel at period end. You will not be charged again.
You keep VIP until the end of the period you have already paid for.
When a paid period ends and is not renewed, VIP is removed automatically after a 2 hour grace period. The grace period gives a renewal payment time to arrive.
The Wipe Pass and Lifetime are single payments, so there is nothing to cancel.

8. Lifetime VIP

"Lifetime" means the lifetime of the MonkeyServers Rust servers, not your lifetime or the life of your Steam account.

VIP Lifetime and VIP+ Lifetime last for as long as MonkeyServers runs Rust servers. You pay once, and there is nothing to renew.
Wipes, maintenance, Rust updates, a server being down for a while, or one of our servers being replaced by another do not end Lifetime.
If we decide to permanently stop running all MonkeyServers Rust servers, Lifetime ends on the day the last one closes. We will tell you at least 30 days before, on this website and on our Discord. Your Lifetime perks keep working until then.
Closing soon after you bought. If the servers close for good, we refund the Lifetime price you paid, minus what the same number of full months would have cost on the Monthly plan of the same rank at the price when you bought. If that comes to zero or less, there is nothing to refund. This means you are never worse off than if you had paid monthly. For example: you paid £39.99 for VIP Lifetime when VIP Monthly cost £3.99, and the servers close 4 full months later. You get back £39.99 − (4 × £3.99) = £24.03.
The same refund applies if we have to close because of something outside our control, for example Facepunch no longer allowing community servers.
If you paid for Lifetime by skin trade, we use the value we confirmed for your trade instead of a card price.
If the servers close, we also cancel all subscription renewals and refund any unused part of a period you have already paid for.

9. Changes to perks

We may need to change a perk. We only do this for a good reason, for example:

Facepunch's rules for community servers change;
a Rust update or a plugin problem means a perk no longer works;
the law requires it.

When we can, we replace it with something of similar value. If a change takes away a significant part of what you paid for, tell us and we will cancel your subscription or give you a fair partial refund.

10. Refunds and chargebacks

If we refund an order in full, the VIP from that order ends.
If you reverse a payment through your bank or card issuer and the reversal succeeds, we remove the perks from that order and block your Steam account from buying in the store.

11. Bans and ending access

Breaking the server rules leads to the penalties listed there: a warning, then bans of 1, 7 and 30 days, then a permanent ban.

Temporary bans. Your VIP is not removed, but paid time keeps running while you are banned. We do not extend it or refund it.
Serious breaches. We may ban you permanently straight away, without the earlier steps, for a serious breach: cheating, hacking or exploiting; getting round a ban; threats, hate speech or sharing someone's personal information; or fraud, including chargeback fraud. You then lose any remaining VIP time, including Lifetime, and we cancel any subscription so you are not charged again. There is no refund.
Other permanent bans. If you are permanently banned after going through all the warning and ban steps in the rules, you lose any remaining VIP time, including Lifetime, and we cancel any subscription so you are not charged again. There is no refund. The rules and every step before a permanent ban are published, so you always get warnings and chances to change first.
Appeals. You can appeal a ban by opening a ticket in our Discord. If a ban was a mistake, we restore your VIP and add back the time you lost.
We may also end your access if the law requires us to.

12. Reporting illegal content

If you see illegal content or behaviour on our servers or Discord, open a ticket in our Discord or email [email protected]. We will remove illegal content and may ban the player responsible.

13. Facepunch and Steam

Rust and all related trademarks and game content belong to Facepunch Studios. Steam belongs to Valve. MonkeyServers is an independent community server. It is not affiliated with or endorsed by Facepunch Studios or Valve.

14. Our responsibility to you

We provide the Service with reasonable care and skill. Game servers sometimes go down or lag, and we cannot promise they never will.
If VIP does not work as described, tell us and we will fix it. If we cannot fix it, we will give you a fair partial or full refund.
We are not responsible for losses we could not reasonably have foreseen, or for in-game losses from normal play, such as being raided.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, or for fraud, or takes away your legal rights as a consumer.

15. Complaints and contact

If something is wrong with an order or you want to complain, open a ticket in our Discord (see our support page) or email [email protected]. You can also write to Daniel Milanesi, 53 Wickham Rd, Beckenham BR3 6QJ, UK. We aim to reply within 5 working days.

16. Changes to these terms

We may update these terms, for example to match a change in the law, in Facepunch's rules or in what we sell. We will post the new version here with a new effective date. If a change is significantly worse for you, we will tell you at least 30 days before it applies, on this website and on our Discord. If you do not agree, you can cancel your subscription before the change applies. Paid time you already have is not affected, unless the law or Facepunch's rules require the change.

17. Law

These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.
